1. About these terms
These Terms of Service govern your use of the Montedo Digital website and the services provided by MONTEGO IT COMPANY LIMITED, 350 Bay Street North, Suite 1300b, Toronto, Ontario, M5H 2S6, Canada (OCN: 1001751246). By using this website or engaging our services, you accept these terms.
2. Our services
Montedo Digital provides outsourced IT services, including mobile app development, preparation of graphics and visual assets for applications, and mobile app publishing (store listings, submission, and release management). The specific scope, timeline, and fees for any engagement are defined in a separate written agreement or statement of work.
3. Quotes and engagements
Any quote or estimate provided through this website or by email is indicative and non-binding until confirmed in a signed agreement. Work begins only after the scope and commercial terms are agreed in writing.
4. Client responsibilities
You agree to provide timely access to the information, materials, accounts, and approvals reasonably needed to deliver the services, and to ensure that any materials you supply do not infringe third-party rights.
5. Intellectual property
Unless agreed otherwise in writing, upon full payment the deliverables created specifically for your project are assigned to you. We retain ownership of our pre-existing tools, frameworks, and know-how, and may reference the work in our portfolio unless you ask us not to.
6. Confidentiality
We treat non-public information shared during an engagement as confidential and use it only to deliver the services. Mutual non-disclosure agreements are available on request.
7. Warranties and liability
We perform services with professional skill and care. To the maximum extent permitted by law, the website is provided "as is", and our aggregate liability arising from or related to the website or these terms is limited to the fees paid for the services giving rise to the claim. We are not liable for indirect or consequential damages.
8. Third-party platforms
App Store and Google Play submissions are subject to those platforms' own rules and review processes. We cannot guarantee approval timelines or outcomes, but we manage the process and respond to review feedback on your behalf.
9. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules.
